Terms & Conditions – Aviyra
Article 1 – Definitions
In these Terms and Conditions, the following definitions apply:
Withdrawal Period
The period within which the consumer may exercise the right of withdrawal.
Consumer
A natural person acting for purposes outside his or her trade, business, or profession.
Day
A calendar day.
Distance Contract
A contract concluded between Aviyra and the consumer through one or more means of distance communication.
Durable Medium
Any medium that enables information to be stored in a way accessible for future reference without alteration.
Right of Withdrawal
The consumer’s right to withdraw from the contract within the applicable withdrawal period.
Trader

Article 3 – Applicability
These Terms and Conditions apply to all offers, orders, and distance contracts concluded between Aviyra and the consumer.
Before placing an order, the consumer will have access to these Terms. If the contract is concluded electronically, the Terms will be made available in a way that allows storage on a durable medium.
If additional terms apply to a specific product or service, the provision most favorable to the consumer shall prevail in case of conflict.
Article 4 – The Offer
All offers are non-binding and subject to availability.
Product descriptions, images, and specifications are provided as accurately as possible. Minor variations in color or appearance may occur due to screen settings or production batches.
Obvious errors or inaccuracies do not bind Aviyra.
Prices displayed include VAT unless stated otherwise. Import duties, customs fees, or local taxes outside the EU may apply and are the responsibility of the customer.

Applicability of the right of withdrawal
Article 5 – The Agreement
The agreement is concluded once the consumer places an order and receives an order confirmation.
Aviyra reserves the right to refuse or cancel orders in case of suspected fraud, incorrect pricing, or insufficient stock.
Electronic payments are processed through secure, encrypted payment providers.
Article 6 – Right of Withdrawal (EU Consumer Law)
Consumers within the European Union have the right to withdraw from the contract within 14 days without providing a reason.
The withdrawal period begins the day after the product is received.
To exercise the right of withdrawal, the consumer must notify Aviyra via email within 14 days and return the product within the following 14 days.
Products must be returned unused, complete, and in original packaging where reasonably possible.
Article 7 – Returns & Refunds
Return shipping costs are the responsibility of the consumer unless the product is defective or incorrect.
Refunds will be processed within 14 days after receipt of the returned product or proof of return, using the original payment method.
Article 8 – Exceptions to the Right of Withdrawal
The right of withdrawal does not apply to:

Personalized or custom-made products

Sealed hygiene products once opened

Products that cannot be returned for health or safety reasons
Any exception will be clearly stated before purchase.
Article 9 – Pricing
Prices will not be increased after an order is placed, except due to changes in VAT or legal requirements.
All prices displayed include VAT for EU customers.
Article 10 – Warranty & Conformity
Aviyra guarantees that products comply with the agreement and applicable EU consumer protection laws.
Consumers are entitled to statutory warranty rights in case of defective or non-conforming products.
Article 11 – Delivery
Orders are processed with care and delivered to the address provided by the consumer.
Delivery times are indicative. If delivery exceeds 30 days, the consumer has the right to cancel the order and receive a full refund.
Risk of loss or damage transfers to the consumer upon delivery.
Article 12 – Payments
Payments must be completed before order fulfillment.
Aviyra does not require advance payments exceeding 50% where legally restricted.
In case of late payment, Aviyra may apply statutory interest and collection costs in accordance with Dutch law.
Article 13 – Complaints
Complaints must be submitted within 2 months after discovering the issue.
Aviyra will respond within 14 days or provide a clear timeline for resolution.

Article 14 – Governing Law & Disputes
These Terms are governed exclusively by Dutch law.
The Vienna Convention on Contracts for the International Sale of Goods does not apply.
Disputes may be submitted to a competent court in the Netherlands or resolved via EU Online Dispute Resolution (ODR) where applicable.
Article 15 – Final Provisions
If any provision of these Terms is found invalid, the remaining provisions remain fully effective.
Any deviations must be recorded in writing or on a durable medium.
